1. Acceptance
By accessing or using Ownsplit (the "Service"), you agree to these Terms of Service ("Terms") and confirm that you have read our Privacy Policy, which describes how we process personal data.
If you do not agree, you must not use the Service.
2. Who may use the Service
You may use the Service only if all of the following are true:
- You can enter into a binding agreement with Ownsplit.
- You are at least 13 years old (or the minimum age of digital consent in your country, if higher).
- You are not prohibited from using the Service under applicable law and you have not been permanently banned by us for a serious breach of these Terms.
- Any registration information you provide is accurate and kept up to date, to the best of your knowledge.
3. Nature of the Service
Ownsplit is a shared expense ledger for people who track informal balances and related notes among friends, family, or colleagues.
The Service is provided "as is" and "as available". Features may change or be paused during maintenance or product updates. We do not guarantee uninterrupted or error-free operation.
The Service is a work in progress; some features may not behave exactly as described.
4. Informal records (not legal instruments)
Amounts, descriptions, and payment or IOU notes you or others enter are informal records intended to help you coordinate in everyday situations. Unless you create separate binding agreements outside the Service, nothing on the Service is intended to create legally enforceable obligations between users.
We do not verify that user-entered information is true, complete, or lawful, or accurate. You use the Service at your own risk with respect to decisions you make based on information shown in the app or on this website.
5. Acceptable use
You will use the Service only for lawful purposes and in accordance with these Terms and applicable law (local, national, and international, as applicable).
You must not: misuse the Service; attempt to disrupt, damage, or reverse engineer it; probe or circumvent security; scrape or overload our systems; impersonate others; harass or threaten users; use the Service for fraud, money laundering, or other illegal activity; or assist anyone else in doing so. We may investigate use of the Service and suspend or terminate access where reasonably necessary to protect users, the Service, or comply with law.
6. Content you provide
You are responsible for all content you submit (for example expense descriptions, comments, images, group names, and profile information). You represent that you have the rights needed to provide that content.
We are not responsible for the legality, accuracy, or appropriateness of user content. We may remove or restrict content that violates these Terms, appears unlawful or harmful, or creates risk for us or others, but we are not obligated to monitor content.
You grant Ownsplit a worldwide, non-exclusive licence to host, store, reproduce, and display your content only as needed to operate and improve the Service and as described in our Privacy Policy.
7. Content standards
You must not post content that:
- Violates anyone's rights (including privacy or publicity) or solicits harassment, threats, or extortion.
- Is false, misleading, or intended to deceive others in a harmful way.
- Is obscene, gratuitously violent, hateful, or otherwise seriously abusive.
- Is illegal or promotes illegal activity.
- Constitutes spam or unsolicited commercial mass messaging.
- In our reasonable judgment, exposes users or Ownsplit to material harm or undue legal risk.
8. Privacy
Our Privacy Policy explains what personal data we collect and how we use it. You must agree to the processing described there to use the Service.
We may disclose information (including account, support, or user content) where required by law, regulation, valid legal process, or to protect rights, safety, and security, as further described in the Privacy Policy.
9. Account security
You are responsible for safeguarding your login credentials and for activity under your account. Notify us promptly at support@ownsplit.com if you suspect unauthorized access.
10. No warranties
To the maximum extent permitted by applicable law, the Service is provided without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of liability
To the maximum extent permitted by applicable law, Ownsplit and its directors, employees, and representatives shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunities, arising out of or related to your use of the Service—even if we have been advised of the possibility of such damages. Nothing in these Terms excludes or limits liability that cannot be limited under applicable law.
12. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, if we must do so to comply with law, or for other reasonable operational or security reasons.
Provisions that by their nature should survive termination (including intellectual-property licences to us limited as stated, disclaimers, limitations of liability, governing law, and dispute-related terms) will survive.
13. Changes to these Terms
We may modify these Terms from time to time. We will post the current version on this website and update the "Last updated" date.
Unless applicable mandatory consumer or other law requires a different process or notice period, changes take effect immediately when posted. Your continued use of the Service after the effective time constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.
Where mandatory law requires us to obtain your explicit consent for specific changes, we will do so in the manner required.
14. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to reflect the parties' intent consistent with applicable law.
15. No waiver
Our failure to enforce any right or provision is not a waiver of that right or provision.
16. Governing law and disputes
These Terms, and any dispute or claim arising out of or in connection with them or the Service, shall be governed as follows: (a) European Union law applies where it governs the matter as uniform EU law; (b) all other matters shall be governed by the national laws of the Member State in which Ownsplit is established, without regard to conflict-of-law rules that would designate another governing law (except where such rules are mandatory and cannot be waived).
Consumers may benefit from mandatory protections and access to courts in their country of habitual residence that cannot be overridden; nothing in these Terms limits those protections.
17. Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ownsplit regarding the Service described here, and supersede prior understandings on the same subject.
